EvCreo is an early-stage startup developing an online platform that helps customers discover party and event vendors and enables vendors to showcase their services and connect with potential customers.
These Terms & Conditions govern your access to and use of https://evcreo.com, including account registration, vendor profiles, photographs, listings, and enquiries.
By selecting the required acceptance checkbox during registration, you confirm that you have read and agree to these Terms & Conditions and acknowledge the EvCreo Privacy Policy.
If you do not agree to these Terms, please do not register for or use the services requiring acceptance.
2. Account Registration
You agree to provide accurate, complete, and current information when creating an account, including your email address, phone number, profile details, and other information requested for the relevant service.
You are responsible for ensuring that you are authorized to provide this information and for keeping your account credentials secure.
You must not impersonate another person or business, create fraudulent accounts, or provide misleading information.
3. Use of the EvCreo Platform
EvCreo provides a platform for discovering party and event vendors, viewing their services and portfolios, and connecting with service providers.
Vendors may register to publish business profiles, showcase their work, and receive customer enquiries.
Unless expressly stated otherwise, EvCreo facilitates discovery and communication rather than directly providing the event services listed by vendors.
Customers and vendors are responsible for independently agreeing on bookings, pricing, payments, cancellations, and service arrangements. This does not exclude any obligations or liabilities imposed on EvCreo by applicable law.
4. Vendor Responsibilities
Vendors are responsible for the accuracy and legality of their listings, descriptions, pricing, availability, business information, and uploaded photographs.
Vendors must:
Provide truthful and non-misleading information.
Upload only content they own or are authorized to use.
Obtain appropriate permissions for photographs containing identifiable individuals.
Comply with applicable laws, licences, and professional requirements.
Honour commitments they accept with customers.
Update inaccurate or outdated information promptly.
EvCreo may review, restrict, or remove listings where reasonably necessary due to suspected fraud, infringement, unlawful content, safety concerns, or violations of these Terms.
A listing on EvCreo does not automatically constitute an endorsement or guarantee of a vendor’s qualifications, reliability, or service quality.
5. Customer Responsibilities
Customers agree to use EvCreo lawfully and provide accurate information when submitting enquiries.
Before engaging a vendor, customers should independently assess the vendor’s credentials, prices, availability, service terms, and suitability for their event.
Any agreement entered into directly between a customer and a vendor remains subject to the terms agreed by those parties and applicable law.
6. Photographs and User Content
You retain ownership of photographs, logos, descriptions, and other content that you own and upload to EvCreo.
By uploading content for publication, you grant EvCreo a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, format, resize, display, and technically adapt that content as reasonably necessary to operate the Platform, display your profile or listing, and improve the services.
Any use of content for promotional purposes beyond ordinary operation of the Platform will be subject to the permissions and notices applicable to that use.
You confirm that you have the rights and permissions necessary to upload the content and authorize its use as described above.
You may request content removal or account deletion through our designated support process, subject to applicable law and legitimate retention requirements.
7. Website Design, User Experience, and Brand Identity
EvCreo reserves the right to modify, redesign, update, reorganize, or improve the Website’s design and presentation from time to time.
These changes may include page layouts, navigation, menus, colours, typography, icons, graphics, mobile responsiveness, accessibility features, interactive components, and other visual or functional elements.
We may make such changes to improve usability, accessibility, performance, functionality, consistency, and the overall user experience, including in response to user feedback and testing.
Brand identity: EvCreo intends to preserve the recognisable identity and core characteristics of its brand while making these improvements. We may refine the presentation of our logo, colours, typography, and other brand elements where appropriate while maintaining the overall identity of EvCreo.
We may introduce, modify, or discontinue website features, subject to applicable law and binding commitments made to users.
This provision does not authorize EvCreo to disregard statutory rights, retrospectively change contractual obligations, or make changes contrary to applicable law.
8. Prohibited Activities
You must not:
Use EvCreo for fraudulent, unlawful, or deceptive activities.
Upload malicious software or attempt unauthorized access.
Impersonate another person or business.
Publish infringing, misleading, abusive, or unlawful content.
Collect or misuse another user’s personal information without authorization.
Interfere with the Website’s security or operation.
Copy, scrape, or commercially exploit protected Platform content without authorization, except where permitted by law.
EvCreo may investigate suspected violations and take proportionate action in accordance with these Terms and applicable law.
9. Intellectual Property
The EvCreo name, branding, original website design, software, graphics, and other Platform materials are owned by or licensed to the relevant rights holder, except for third-party materials and user-submitted content.
You may not reproduce, distribute, modify, or commercially exploit protected Platform materials without authorization, except as permitted by law.
EvCreo™ is a trademark of Lloyd R. Fernandes.
Nothing in these Terms transfers ownership of your content to EvCreo.
10. Third-Party Services and Listings
EvCreo may display vendor listings, external links, contact details, or references to third-party services.
Vendors are generally independent service providers and are not automatically employees, agents, or representatives of EvCreo.
Unless expressly stated otherwise, EvCreo does not guarantee the accuracy of every listing, vendor availability, or the quality of services independently provided by vendors.
Nothing in this clause excludes any duty or liability imposed on EvCreo under applicable law.
11. Privacy and Personal Information
EvCreo may collect information such as your email address, phone number, account details, photographs, business information, and technical usage data.
We process personal information for purposes including account administration, verification, displaying vendor listings, facilitating enquiries, providing support, protecting the Platform, and improving the user experience, as described in our Privacy Policy.
We will handle personal information in accordance with applicable law and the published Privacy Policy.
12. Account Suspension and Termination
You may request account closure by using the relevant account settings or contacting suggestions@evcreo.com.
EvCreo may restrict, suspend, or terminate access where reasonably necessary due to material violations of these Terms, suspected fraud, security risks, unlawful conduct, or legal requirements.
Where appropriate and legally permitted, we will provide notice and an opportunity to resolve the issue.
Account termination does not override applicable rights concerning personal information, data deletion, or accrued legal obligations.
13. Website Availability and Liability
EvCreo aims to provide a reliable service but does not guarantee uninterrupted availability or error-free operation.
To the extent permitted by applicable law, EvCreo will not be liable for indirect or consequential losses arising from use of the Platform.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including applicable statutory consumer rights.
14. Changes to These Terms
EvCreo may revise these Terms to reflect changes in its services, features, operations, or legal obligations.
Updated Terms will be published on https://evcreo.com with a revised “Last Updated” date.
Where changes are material, EvCreo will provide appropriate notice and obtain renewed acceptance where required by applicable law.
Changes will not retrospectively remove accrued rights or override mandatory legal protections.
15. Governing Law
These Terms are governed by the laws of India, subject to applicable legal requirements.
Disputes will be handled by competent courts or forums having jurisdiction under applicable Indian law.
Nothing in these Terms limits a user’s statutory consumer rights or access to legally available remedies.
